Public Interest Litigation Filed Against CHB Housing Scheme 2010

CHB Self-Financing Housing Scheme 2010 – PIL Filed in the High Court

Chandigarh Housing Board’s newly launched Self-Financing Housing Scheme 2010 was challenged in the Punjab and Haryana High Court on Tuesday, December 14, 2010.

CHB’s Self-Financing Housing Scheme 2010 had offered 160 two-bedroom freehold residential flats in Sector-51-A, Chandigarh.

A division bench of the Punjab and Haryana High Court, consisting of the Chief Justice Mukul Mudgal and Justice Ranjan Gogoi issued notices to the Union Territory Administration of Chandigarh and Chandigarh Housing Board (CHB) on a Public Interest Litigation (PIL) filed by Jagmohan Singh Bhatti.

Petitioning Jagmohan Singh Bhatti sought court’s directions to restrain the Chandigarh Housing Board from selling the brochure and application form of the residential flats scheme and accepting the subscription from the public until the clause of accepting any number of application forms from a single person was removed or deleted or amended or modified. As, this clause of accepting any number of application forms from an applicant reduced the chances of the allotment of the flats to the public and would encourage and regularize business for the powerful and wealthy persons.

The petitioner Jagmohan Singh Bhatti said that the Self-Financing Housing Scheme 2010 launched by the Chandigarh Housing Board was against the laid down objective of the establishment. The petitioner also sought removal of the clause wherein a candidate can get an assured residential flat by paying a higher amount.

However, the division bench of the Punjab and Haryana High Court declined to stay the policy or to quash the CHB Self-Financing Housing Scheme 2010. The court only issued notices to the Chandigarh Housing Board and Chandigarh Administration and asked them to file a reply to the notice by the first week of January 2011.
