Uttar Pradesh Housing and Development Board – Terms and Conditions for Lohramau Marg Sultanpur PMAY Flats

Sultanpur (Uttar Pradesh, India), April 28, 2018

The Uttar Pradesh Avas Evam Vikas Parishad (UPAVP) has launched a residential PMAY flats scheme in Lohramau Road (UPAVP Scheme Code Lohramau Marg Yojna) in Sultanpur, Uttar Pradesh.

In UPAVP Sultanpur Lohramau Road PMAY flats scheme, the Uttar Pradesh Housing and Development Board has offered total 192 residential flats for the different categories.

Registration for UPAVP Sultanpur Lohramau Road PMAY residential flats scheme is open for the citizens of India from Tuesday, March 20, 2018 to Saturday, May 05, 2018.

The Uttar Pradesh Avas Evam Vikas Parishad will allot a flat in UPAVP Sultanpur Lohramau Road PMAY residential flats scheme subject to fulfillment of certain terms and conditions.

The General Terms and Conditions for the UPAVP Sultanpur Lohramau Road PMAY Flats Scheme

1. Allotment of a residential flat in UPAVP Sultanpur Lohramau Road PMAY flats scheme shall be governed by the provisions contained in the Uttar Pradesh Avas Evam Vikas Parishad Adhiniyam, 1965 (U.P. Act No. 1 of 1966).

2. UPAVP Sultanpur Lohramau Road PMAY scheme is a residential scheme only. Therefore, the allottee shall not use the flat for any purpose other than residential.

3. The allottee shall not be permitted to carry out any kind of construction or change the specifications approved in the sanctioned building plan for the residential flat. Legal action can be taken on violation. In case of a violation of any regulation or direction, the Uttar Pradesh Housing and Development Board can cancel allocation of the flat, sale deed executed and its registration. In addition to the above, the rules, orders and decisions of the Government or UPAVP will be effective on allotment.

4. If the allottee or applicant dies, then according to the rules of the Uttar Pradesh Avas Evam Vikas Parishad, his or her successor will be required to provide documents such as the succession certificate, death certificate, indemnity bond, and no objection certificate from other successors, etc. for effecting the registration of allotted flat in the successor’s name. However, the change in succession will be effective only if there is no dispute.

5. The allottee shall not be entitled to divide the allotted residential flat or to amalgamate it with any other flat.

6. The allottee will accept the residential flat on “as is where is basis” on allotment from the Uttar Pradesh Housing and Development Board unconditionally.

7. The Uttar Pradesh Avas Evam Vikas Parishad shall be fully competent to make or alter rules and regulations framed by it and these shall be binding on the registered applicants of UPAVP Sultanpur Lohramau Road PMAY flats scheme.

8. For the matters not mentioned or covered in the prescribed brochure, the relevant Government orders and provisions of the Uttar Pradesh Avas Evam Vikas Parishad will be effective.

9. The present cost or price of the residential flat in UPAVP Sultanpur Lohramau Road PMAY flats scheme is tentative to the extent that any enhancement in the cost of land awarded by the Competent Authority under the Land Acquisition Act shall also be payable proportionately, as determined by the Uttar Pradesh Housing and Development Board.

10. The price of the flat may vary at the time of handing over possession of the allotted flat. The price variation either may be due to increase in the development cost of the flats or due to liability on the part of the Uttar Pradesh Avas Evam Vikas Parishad to pay enhanced land compensation or acquisition cost or ex-gratia as per the order of the Court or by the State Government or by the UPAVP themselves. Therefore, the allottee should agree and pledge to pay the proportionate increase in the cost of flat and shall pay such increase in the price, as demanded by the Uttar Pradesh Avas Evam Vikas Parishad within a specific period of its demand.

11. Such beneficiaries, who have already obtained accommodation by availing the benefits of grant or rebate under any residential scheme of the Government of India or State Government, will not be eligible to apply in UPAVP Sultanpur Lohramau Road PMAY flats scheme.

12. Only those applicants who are under the Lower Income Group (LIG) and registered with the Citizen Service Centre (CSC), Government of India, State Urban Development Agency (SUDA), District Urban Development Agency (DUDA), Nagar Nigam (Municipal Corporation) or Nagar Palika (Municipality) are allowed to apply in this UPAVP Sultanpur Lohramau Marg PMAY housing scheme.

13. Verification of the registered beneficiary will be done based on the Aadhar number, which the applicant has registered with the Government of India, State Government, SUDA, DUDA, Nagar Nigam or Nagar Palika.

14. The State Level Sanctioning and Monitoring Committee (SLSMC) and a committee constituted by the government in compliance with the transparent process approved will allocate the residential flats in UPAVP Sultanpur Lohramau Road PMAY housing scheme.

15. If the number of applications received for registration is greater than the number of available property, allotment of a residential flat in UPAVP Sultanpur Lohramau Road PMAY housing scheme shall be made to the eligible applicants through a manual lottery draw of lots.

16. The tentative date of lottery draw of lots for UPAVP Sultanpur Lohramau Road PMAY flats scheme is on or before November 05, 2018. The actual date, time and place of lottery draw of lots shall be informed to the applicants on their registered mobile numbers, by means of publication in the daily newspaper(s) and will also be available at the website of Uttar Pradesh Housing and Development Board.

17. After the lottery draw of lots, details of the successful applicants and their allotment of the flats will be uploaded on the Uttar Pradesh Avas Evam Vikas Parishad website as soon as possible.

18. After the completion of the allocation process, names of selected eligible beneficiaries in UPAVP Sultanpur Lohramau Road PMAY flats scheme will be displayed at the allocation point and related Property Management Office.

19. Number of the residential flats available for allotment in UPAVP Sultanpur Lohramau Road PMAY flats scheme may increase or decrease at the time of lottery draw.

20. If a registered applicant wants to withdraw his or her deposited registration money before the date of the lottery draw of lots, then upon canceling his registration application based on his written consent, the deposited registration money will be refunded without any deduction and without any interest.

21. If an applicant has been successful in getting a flat in the lottery draw of lots, but applies for the cancellation of the registration and allotment before the last date of depositing the allotment money, then the deposited registration money will be refunded by deducting 20 per cent of the amount and without any interest.

22. If a successful applicant applies for the cancellation of the registration and allotment after 3 months from issue of allotment letter then the deposited registration money will be refunded by deducting 50 per cent of the amount and without any interest.

23. On successful allocation of a flat, the balance amount payable will be Rs. 175,000 (Rupees One Lakh Seventy Five Thousand Only), which is to be paid in 5 years in 60 monthly installments with 9.50 percent interest per annum. Each EMI (Equated Monthly Installment) will be of Rs. 3,675. If any installment is not paid in a timely manner, then an additional interest of 02 percent will be charged as a penalty along with the simple interest of 9.50 percent (total 11.50 percent) per annum.

24. If all the outstanding amount is paid by the allottee within 03 months from the date of the allotment letter, no interest will be payable.

25. If the applications received are less than the residential flats reserved under any reserved category, the remaining flats will be transferred to the General Category Applicants at the time of lottery draw of lots.

26. On allotment of a residential flat, the allottee shall be informed of the dues payable for the said flat through an allotment letter.

27. The earnest money deposited by the unsuccessful applicants will be refunded in their savings bank account without any interest within one month from the lottery draw date through R.T.G.S.

28. The Uttar Pradesh Avas Evam Vikas Parishad is fully authorized to fix the final prices for the residential flats developed by it, and its decision in this regard shall be final.

29. The area of a residential flat allotted in UPAVP Sultanpur Lohramau Road PMAY flats scheme may slightly vary at the time of handing over of the possession.

30. No change shall be permitted in the application category of an applicant in any circumstances after the registration has been done for UPAVP Sultanpur Lohramau Road PMAY flats scheme.

31. Only such applications shall be deemed to be valid, which are accompanied by the specific earnest money (Rs. 25,000) in the form of Online Payment, Demand Draft, Banker’s Cheque, or Pay Order in favor of the ‘Uttar Pradesh Avas Evam Vikas Parishad’ drawn at Sultanpur. However, the Uttar Pradesh Avas Evam Vikas Parishad shall not accept earnest money deposit in cash.

32. The cost and expenses of preparation, stamping, and registering of the legal documents and its copies and all other incidental expenses will be borne by the allottee, and who will also pay the stamp duty of transfer of immovable property levied or any other duty or charge that may be levied by any authority empowered in this behalf.

33. The allottee will be liable to pay all rates, taxes, charges and assessment of every description imposed by any Authority empowered in this behalf, in respect of the residential flat and by any other statutory body, whether such charges are imposed on the residential flat or on the building constructed thereon, from time to time. Goods and Service Tax (GST), if applicable, shall also be borne by the allottee(s).

34. The allottee at his or her expense will take permission for sewerage, electricity, and water connections for the residential flat allotted to him or her from the concerned departments of the Uttar Pradesh Avas Evam Vikas Parishad or from the concerned competent authority in this regard.

35. No single allottee will have any exclusive or any special right on the roof of top floor. It will be available for community services of all residents of the same tower.

36. The Uttar Pradesh Avas Evam Vikas Parishad will hand over possession of the allotted flat after 3 years from issue of the allotment letter.

37. The address given in the application form for UPAVP Sultanpur Lohramau Road PMAY flats scheme should be complete. The applicant should inform about any change in the mailing address immediately to the Uttar Pradesh Housing and Development Board and concerned bank.

38. If an applicant gives wrong information in an affidavit or application or shall hide any facts, the allotment to him or her shall be immediately cancelled and even if the residential flat is allotted, the Uttar Pradesh Housing and Development Board shall be competent to cancel such allotment and take back possession of the flat.

39. The residential flat shall continue to vest in the Uttar Pradesh Avas Evam Vikas Parishad until the entire consideration money together with interest and other amount, if any, due to the Uttar Pradesh Avas Evam Vikas Parishad on account of the sale is paid.

40. If due to any “force majeure” or such circumstances beyond Uttar Pradesh Housing and Development Board’s control, the UPAVP is unable to make allotment or give possession of the allotted residential flat, the entire registration money or the deposit, depending on the stage of allotment, will be refunded to the allottee along with a simple interest at the rate of 4% per annum.

Resolution of a Dispute between Uttar Pradesh Housing and Development Board and Allottee(s)

41. Any dispute between the Uttar Pradesh Housing and Development Board and the allottee shall be subject to the territorial jurisdiction of the Civil Courts having jurisdiction over Sultanpur or the Courts designated by the Honorable High Court.
