Reservation for Farmers or Land Oustees in YEIDA Yamunotri Housing Scheme BHS-04/2014

Greater Noida (Uttar Pradesh, India), October 31, 2015

The Yamuna Expressway Industrial Development Authority (YEIDA) had launched a multistoried residential flats scheme (YEIDA Scheme Code BHS-04/2014) in Sector-22A Yamuna Expressway (District Gautam Budh Nagar) in Uttar Pradesh on October 23, 2014.

In the YEIDA Yamunotri Housing Scheme BHS-04/2014, the Yamuna Expressway Industrial Development Authority was offering total 2862 residential flats for allotment to the various categories of applicants.

Allotment of a residential flat in the YEIDA Yamunotri Housing Scheme BHS-04/2014 shall be governed by the provisions contained in the Uttar Pradesh Industrial Area Development Act, 1976 (U.P. Act No. 6 of 1976).

Yamuna Expressway Yamunotri Housing Scheme BHS-04/2014: Farmers or Land Oustees Reservation

As per Uttar Pradesh Government’s current reservation policy, 17.50% of the total number of residential flats are reserved for the farmers or land oustees in the YEIDA Yamunotri Housing Scheme BHS-04/2014.

Out of 17.50% multistory residential flats reserved for Farmers or Land Oustees in the YEIDA Yamunotri Housing Scheme BHS-04/2014, 18% multistoried flats (that is 90 out of 501 flats) will be reserved for Scheduled Castes (SC) and Scheduled Tribes (ST) applicants.

Keeping in view the provision under Section 43 of the Persons with Disabilities Act, 1995 and a decision taken in 49th Board Meeting of Yamuna Expressway Industrial Development Authority held on February 12, 2014, a 3% horizontal reservation (that is 15 out of 501 flats) shall be kept for Handicapped Persons in Farmers or Land Oustees Category.

Accordingly, the Yamuna Expressway Industrial Development Authority had reserved balance 396 flats for the Farmers or Land Oustees Category applicants in the YEIDA Yamunotri Housing Scheme BHS-04/2014.

After allotment of flats to the reserved categories, the remaining flats will be allotted to the persons registered under the General Category.

The Applicable Eligibility Terms and Conditions for the Farmers or Land Oustees

Only those farmers, whose agricultural land Yamuna Expressway Industrial Development Authority has acquired or purchased, are eligible to apply in this scheme. The detailed eligibility conditions and the procedure for allotment under Farmers Category are given below:

1. The applicant should be competent to contract and have attained the age of majority.

2. Only those bona fide farmers or land oustees are eligible to apply in this scheme, whose land has been acquired or purchased unhindered and without any encroachment and Yamuna Expressway Industrial Development Authority has taken possession on or before March 31, 2014. An undertaking on Stamp Paper of Rs. 10 is to be given by the applicant farmer as per the format (Undertaking-I) given in the scheme brochure.

3. In case, a farmer or landowner has already been allotted a residential plot, flat, or a built-up house in his or her name or to his or her spouse or dependent children, in any of the earlier residential schemes of the Yamuna Expressway Industrial Development Authority, he or she shall not be eligible to apply in this scheme.

4. In case, there is more than one joint-khatedar, all joint khatedars can apply under this scheme. Draw between all such eligible joint khaedar of a khata shall be made and one successful applicant, out of all joint-khatedars, shall be selected and will be included in the final lottery draw of lots.

5. Under this category, successful applicant or allottee cannot transfer the allotted multistory flat up to 5 years from the date of allotment.

6. No encroachment should have been done by the applicant on land acquired or purchased by the Yamuna Expressway Industrial Development Authority irrespective of the acquired land or any other land against which the application for allotment is being made in this scheme. A declaration to this effect shall have to be given on Stamp Paper of Rs. 10 by the applicant farmer as per the format (Undertaking-II) given in the scheme brochure.

7. The applicant or allotee has received entire compensation of the land acquired without any contest or protest based on a karar or consensus. The applicant has to submit Form-11 issued by the Competent Authority with the application form.

8. If, on verification or at any stage it is found that there is a violation of any of the above-mentioned conditions, then the application will be rejected and the registration money will be refunded without any interest.

The Application Forms and Scheme Brochure for the Farmers or Land Oustees Category Applicants

There are separate application forms available for Farmers Category Applicants, which can be availed from the Yamuna Expressway Industrial Development Authority office and submitted at designated Bank Branches. The applicants will need to submit their application forms with the relevant documents as per the Terms and Conditions mentioned in the scheme brochure.
